Service Agreement
By receiving service by Burz Gaming Servers (referred to as Burz Gaming), you will have accepted all of the terms in this agreement. Burz Gaming, the preparers of all kinds of content on this site, employees, persons and organizations authorized by Burz Gaming have no criminal and legal responsibility for your claim for any material / moral damages that may arise from your failure to read these terms or to act in accordance with them. Burz Gaming, at any time, has the right to update and change this agreement unilaterally without prior notice.
1. Responsibilities
1.1: Burz Gaming will provide the service requested by the customer. With the order acceptance message, Burz Gaming will accept that it has collected the relevant fee and will undertake to provide the service specified in the order in question.
1.2: The payment method, VAT differences will be specified with the total amount to be deducted during the order and the fees that the customer must pay according to the payment preferences will be notified by Burz Gaming.
1.3: After the order acceptance and approval of the transactions, Burz Gaming will send the necessary information regarding the service in the customer order detail to the customer and the service will have started. The responsibility for the protection of the relevant information is the responsibility of the customer and the customer will be responsible for any loss and damage that may arise from these issues.
1.4: The customer undertakes to comply with the statements and warnings received by Burz Gaming within the service received. The customer declares, accepts and undertakes to comply with any warnings or notices issued by Burz Gaming while using the service.
1.5: The customer undertakes not to access files or programs that he / she does not have the right to access by using the software and programs he / she has within the service, not to create any problems due to such a problem, and to cover the damage in case of problems and problems that may occur.
1.6: The customer, all files, documents, programs, websites, etc. hosted within the service. accepts and undertakes that he / she is responsible for all transactions that he / she will benefit from, and accepts and undertakes to bear all legal and criminal liability that may arise from the illegality of such data, information and statements. No fault can be attributed to Burz Gaming for any problems that may arise in this regard. Burz Gaming does not review, verify, endorse or endorse the pages before they are submitted or take any responsibility for the pages made by the user in any way. Burz Gaming may terminate user accounts for violating these guidelines or for any other reason or because Burz Gaming believes it is harmful to its business or the business of any of its users. Burz Gaming has the right to delete unlawful acts and actions without notifying the customer as soon as it learns about them.
1.7: Burz Gaming cannot be held responsible for any material or moral damages that may arise from the misuse of customer data within the service provided, data content, all data used by e-mail. Backup and storage obligations of the data belong to the customer. Burz Gaming is not responsible for errors, damages and losses that may occur due to interruption or loss of data that may occur in Burz Gaming services.
1.8: If the customer defames the company, negatively criticizes (exaggerates), organizes such campaigns on the internet or other platforms, the account and all services will be canceled and our company will not accept any responsibility.
1.9: If the customer does not fulfill its responsibilities and commitments by acting contrary to any article of this contract or if it is determined that the information declared on the front side of this contract is not correct, Burz Gaming may access the customer's server and examine the files.
1.10: The customer cannot hold our company responsible in case of a software problem not caused by us. Server services are provided unmanaged, all responsibility belongs to the customer.
1.11: The customer will receive the service within 48 hours at the latest after making the payment for the service ordered. If he/she cannot receive his/her service within this period, he/she will be able to claim his/her payment back if he/she requests.
2. Pricing
2.1: The fee to be paid for the services specified in this contract is the amount specified during the order process. If VAT is not included in the specified fees, it is calculated by including it later and the collection is realized by showing it to the customer.
2.2: Burz Gaming reserves the right to make prospective changes to prices and tariffs without prior notice. The customer accepts, declares and undertakes the changes that may occur in advance regarding these changes.
2.3: Burz Gaming reserves the right to open and close the relevant service until the customer completes the payment transaction.
3. Suspension
3.1: Burz Gaming reserves the right to stop and cancel the services provided to the customer in case of problems such as problems with payment, non-payment in customers with bank transfer / EFT payment orders, or due to the provisions and obligations.
3.2: It is forbidden to have content on our servers that violates both copyrights and Turkish law. This content includes bruteforce, spam, ddos, hack, crack, dos, warez, adult and all kinds of copyrighted files.
3.3: In case of detection of illegal transactions such as bulk e-mail sending (spamming), fraud with phishing, attacking internal or external networks through the server provided to the customer, it accepts, declares and undertakes that the server will be deactivated by Burz Gaming without the need for further notice and that the fees paid until that date will not be refunded in any way.
3.4: The security of all software on the server belongs to our customers. Burz Gaming is in no way responsible for any issues that may arise with your software.
3.5: If the customer does not pay the invoice on the payment date specified in the server services, the service is suspended and Burz Gaming is not responsible for what will happen in case of suspension.
3.6: It is forbidden to make attack output through our servers, in the detection of such a situation, Burz Gaming reserves the right to stop or cancel the service without asking the customer.
3.7: It is forbidden to use or up/down server services in a way that may affect our other customers to consume excessive internet consumption. In case of detection, the customer will be warned. If the consumption continues despite the warning, restrictions will be applied.
3.8: Since SSD disks are shared in virtual server services, long-term high read/write operations are not allowed. If detected, the customer will be warned. If the operation continues despite the warning, restriction will be applied.
4. Communication
4.1: The parties have accepted, declared and undertaken to accept, declare and undertake the postal addresses specified in the order address as the legal residence for all kinds of notifications arising from the contract. All notifications made to these addresses will be deemed to have been notified even if they do not reach the parties. Unless changes to these addresses are notified to the other party in writing, the old addresses will be valid.
4.2: Burz Gaming may send messages, information, letters, warnings, payment notices, account movement charts, account statements to the e-mail address declared by the customer during the contract period. The customer cannot claim that such electronic messages have not been received or not received, and declares, accepts and undertakes that such messages will be deemed to have been legally notified 1 day after the date they are sent.
5. Return Conditions
5.1: Refunds are only valid for web hosting services. For other services, the customer cannot request a refund.
5.2: If the customer meets the return conditions in the web hosting service purchased, the customer must submit the return request to Burz Gaming within 7 days after the service is activated. Return requests exceeding 7 days cannot be refunded in any way.
5.3: The customer cannot request a refund of the credit loaded on the system or the next month / year payments made for the purpose of extending.
5.4: From the refund requests accepted by Burz Gaming, if the customer cannot issue a refund invoice, it deducts the VAT rate and refunds the remaining fee after deducting the bank transfer / EFT fee.
5.5: If a refund request is made, Burz Gaming reserves the right to fulfill this request within 1 week at the latest.
6. Failure Situations
6.1: Since servers are electronically operated devices, there is a risk of failure no matter how much the necessary and optimal conditions are provided. Spare parts for failed servers will be provided as soon as possible.
6.2: Our company is not responsible for any damages arising from the supply of server spare parts.
6.3: All backups belong to the customer, Burz Gaming cannot be held responsible if your data is deleted in cases such as disk failure.
6.4: Our company does not accept any responsibility for the data loss or damages you experience in the errors made in the managed services provided with server services.
6.5: Our company cannot be held responsible for the downtime of the servers in case of data center or IP changes in server services. The maximum time for the devices to become active is 10 business days.
Privacy Terms
Online Payment
We care about the security of your card information more than anything else in your payments with credit cards or domestic debit cards. For this reason, we ensure that the card information you enter is sent encrypted even in environments such as internet cafes etc. thanks to the 256-bit SSL certificate, making it impossible to track. We have developed a simple virtual keyboard as a precaution against malicious software such as keyloggers that record the data entered from the keyboard. With all these measures, we aim to keep your credit card information completely secure when you shop on our site, so much so that even we cannot see the card information you pay with.
Information Received
Depending on the service you receive/payment you make, some or all of the following information may be requested from you: Your name, surname, telephone number, address, Turkish ID number, fax number, e-mail address. Additional information/documents other than these may also be required. If necessary, you are obliged to deliver the information requested from you to Burz Gaming within the requested period.
Your T.C. identification numbers are stored in the system in order to invoice you and to find a real interlocutor when necessary. Your T.R. identification numbers will only be used for the purpose of invoicing and submitting them to legal authorities when necessary. It is not possible to use them or share them with third parties other than legal authorities.
The information collected about you through the Burz Gaming Website is not shared with third parties. Your information will be used to contact you and to keep you informed about developments related to Burz Gaming. If Burz Gaming decides to share your information with any third parties, this will only be with your consent. You are free to delete the information collected from our system at any time (unless you receive service from Burz Gaming).
